Terms and Conditions

1. The Competition is promoted by Mitsubishi Electric/BDT (exclusive distributor of Mitsubishi Electric products in NZ), and affiliated companies.
2. A participant in this competition is referred to as ‘entrant’ or ‘you’.
3. This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook.

Entry and Eligibility

1. The Competition is open to persons 13 years old or over who reside in New Zealand.
2. Entry into the competition starts Wednesday 15th of August 2012 at 10:00 AM NZST and will close Friday 25th of October 2013 at 11:00 PM NZST.
3. Employees or immediate families of Mitsubishi Electric/BDT or affiliated companies are not eligible to enter the competition or receive any prize.
4. You may only enter the competition through the applicable application on Facebook. Entry into the competition is automatic upon submission of a correct and fully completed online entry form.
5. Participants can only enter once into the competition.
6. No purchase of products or services is necessary to enter the Competition.
7. Mitsubishi Electric/BDT and affiliated companies have absolute discretion to accept or reject any entry.
8. Should an entrant upload an image which is inappropriate they shall be automatically removed from this competition. Additional to this, this ‘entrant’ will be subject to being banned/blocked from the Mitsubishi Electric in NZ page.
9. Mitsubishi Electric reserves the right to deem whether an image is inappropriate.
10. The Competition will run as advertised within the Facebook application, end date can be changed or updated at the discretion of Mitsubishi Electric/BDT or affiliated companies.
11. By submitting an entry each person consents to the company who is promoting the application using the entrant’s name and entry for the purposes of promotion, marketing and publicity in any and all media, worldwide, for an unlimited period, without notice to the entrant and without payment of any fee or compensation of any kind.
12. We reserve the right to reject any entry, which is in our opinion, attempting to defraud the Competition.
13. We accept no liability for late, lost, delayed or misdirected entries that are not received for any reason, or any phone, line, network and/or any server technical failure involved in any communication related to the Competition.
14. Entries are deemed to be received at the time of receipt in the Competition database.

Voting Conditions

1. Voting will run from Thursday 31st of October 2013 at 10:00 AM NZST until Wednesday 13th of November 2013 at 9:00 PM NZST.
2. Final votes will be audited by Black Diamond Technologies Ltd and the result confirmed Friday 15th of November 2013 at 10:00 AM NZST via Facebook.
3. The finalists will be notified of their placing via email on 15th November 2013.
4. Staff of BDT are excluded from voting in this competition.
5. Votes are limited to one per person.
6. To be eligible to vote an individual must have liked Mitsubishi Electric in NZ’s Facebook page.
7. Entering your name/email address is confirmation of identity. Votes cannot be entered on behalf of another individual.
8. Votes deemed illegitimate or suspect may be removed at the discretion of BDT.

Selection of the Finalists

1. The finalists will be selected by Mitsubishi Electric at their sole discretion.
2. We reserve the right to select an alternate Finalist if we decide at our sole discretion that a Finalist chosen or his/her entry does not comply with these terms and conditions.
3. In accordance with the Terms & Conditions noted, the Finalists chosen consent to the company who is promoting the application using the photo/s they upload for the purposes of promotion, marketing and publicity in any and all media, worldwide, for an unlimited period, without notice to the entrant and without payment of any fee or compensation of any kind.
4. In accordance with the Terms & Conditions noted, the Finalists chosen consent to the company who is promoting the application altering the photo/s they upload to include a Designer Series heat pump for the purposes of being displayed as one of the finalists on the Mitsubishi Electric in NZ Facebook page.
5. Finalists chosen will have their photos selected, altered to include a Designer Series heat pump if possible, have this photo re-uploaded onto the Mitsubishi Electric in NZ page’s app housing the competition, and be sent a subsequent email notifying they are a finalist.

Selection of the Grand Prize Winner

1. The grand prize winner will be determined as the finalist who gains the most votes for their “Show us your style” photo entry upon completion of the competition.
2. We reserve the right to select an alternate grand prize winner if we decide at our sole discretion that the grand prize winner or his/her entry does not comply with these terms and conditions.
3. Should the event arise where two or more finalists have the same number of votes upon completion of the competition, Mitsubishi Electric reserves the right to select the Grand Prize winner at their sole discretion. The finalist/s tied with the Grand prize winner then become the Runners-up prize winner/s.
4. The grand prize winner will be contacted by email or phone within the week following the closing of the competition to notify the grand prize winner of his or her success and to provide a contact number of the Promoter. The grand prize winner will be required to call the Promoter on the number provided, or reply by email, in order for them to claim their prize.
5. If we are unable to make satisfactory contact with the Prize Winner for any reason within five days of the Prize Winner being announced, we reserve the right to re-allocate and re-announce the Prize.

Selection of the Runners-up prize/s

1. The Runners-up prize/s will be determined as the finalists who have gained the 2nd and 3rd most votes respectively for their ‘favourite room’ upon completion of the competition.
2. We reserve the right to select an alternate Runners-up prize winner if we decide at our sole discretion that a Runners-up prize winner or his/her entry does not comply with these terms and conditions.
3. Should the event arise where two Runners-up finalists have the same number of votes upon completion of the competition, Mitsubishi Electric reserves the right to select the Runners-up winner/s at their sole discretion.
4. The Runners-up will be contacted by email/phone within the week following the closing of the competition to notify the Runners-up winners of his or her success and to provide a contact number of the Promoter. The Runners-up winners will be required to call the Promoter on the number provided, or reply by email, in order for them to claim their prize.

Grand Prize

1. There is 1 prize of a Designer Series heat pump package, up to the value of $4,019, available to be won.
2. The Designer Series heat pump package consists of 1 Designer Series high wall heat pump system, and installation up to or equal to the value of $1,000 and no more. The winner will have the choice of indoor heat pump colour.
3. Should the Designer Series package in which the Grand prize winner chooses, including any extras or upgrades, come to a total exceeding that of the $4,019 specified, any additional costs above this specified $4,019 will then be liable upon the Grand prize winner.
4. Subject to any changes under clause 6 below, the ‘Prize’ will be as outlined in the competition promotion.
5. The Prize Winner is responsible for all costs and expenses associated with prize acceptance and use not specified herein as being provided, including, but not limited to meals, gratuities, transport, incidentals, and all other expenses not specifically mentioned above. Any unused portion of the Prize is forfeited.
6. Any travel and expenses are the responsibility of the winner.
7. It is the Grand Prize Winner’s responsibility to notify any change in email address or phone number by notice in writing to: marketing@bdt.co.nz. We will not be liable for any failure to receive the prize.
8. The prize cannot be exchanged for cash. We reserve the right to provide an alternative prize at our absolute discretion if for any reasons outside of our reasonable control the prize is unable to be supplied.
9. To the fullest extent permitted by law, all express and implied representations and warranties in relation to the Prize are excluded. In particular, Mitsubishi Electric/BDT and affiliated companies give no warranty with respect to the quality of the Prize or its suitability or fitness for any purpose.

Runners-up Prize/s

1. There are 4 runners-up prizes consisting of 50L of paint from the Dulux Range, the colour of which is at the choice of the Runners-up prize winner, each available to be won.
2. Subject to any changes under clause 6 below, the ‘Prize’ will be as outlined in the competition promotion.
3. The Prize Winner is responsible for all costs and expenses associated with prize acceptance and use not specified herein as being provided, including, but not limited to meals, gratuities, transport, incidentals, and all other expenses not specifically mentioned above. Any unused portion of the Prize is forfeited.
4. Any travel and expenses are the responsibility of the winner unless otherwise specified by the company running the competition.
5. It is the Grand Prize Winner’s responsibility to notify any change in email address or phone number by notice in writing to: marketing@bdt.co.nz. We will not be liable for any failure to receive the prize.

Intellectual Property

1. Entrants acknowledge that all intellectual property rights in the Competition belong to Mitsubishi Electric/BDT and affiliated.
2. Each entrant warrants that their entry complies with the terms and conditions of this Competition, and does not infringe any third party intellectual property rights or any New Zealand law and that the entrant has all necessary right, title and interest to give the license referred to in clause 25.

Publicity

1. By entering the Promotion, you consent to the Promotion Sponsor’s and it’s designees use of your name, city of residence, photograph, voice, statement and image for any publicity and advertising purposes, in any and all media, now or hereafter devised, worldwide in perpetuity, without additional notification, permission or compensation, except where prohibited by law.
2. As a condition of winning, the installed heat pump system will be professionally photographed for promotional purposes by Mitsubishi Electric NZ/BDT. Photography will be taken on a mutually agreed upon date/time that suits both parties within 3 months of installation of the heat pump package. These images will be the property of Mitsubishi Electric and may be used for the purposes of promotion, marketing and publicity in any and all media, worldwide, for an unlimited period, without notice and without additional payment of any fee or compensation of any kind.

Governing Law

1. This Competition and these terms and conditions shall be governed by New Zealand law and the courts of New Zealand shall have exclusive jurisdiction to hear and determine all issues and disputes that may arise in relation to this Competition or these terms and conditions. Entrants submit to the jurisdiction of the New Zealand courts and agree that the New Zealand courts are a convenient forum in which to resolve any issue or dispute arising out of or in relation to this Competition.

General Conditions

1. We reserve the right to alter, amend or supplement these terms and conditions from time to time at our absolute discretion. You agree that you will be bound by such changes and that you shall not hold us liable for any losses resulting from any such changes.
2. We alone will be the arbiters of any question of interpretation of these terms and conditions and any aspect of the Competition or its content. Our decision as to any matter arising out of or in connection with this Competition shall be final and conclusive.
3. In the event of any breach of these terms and conditions we reserve the right to refuse entry to the Competition and/or disqualify the entrant in question from any further participation in the Competition, and/or disqualify any entry and our decision is final.
4. If for any reason this Competition is not capable of running as planned, we reserve the right in our sole discretion to discontinue, modify or suspend the Competition.
5. To the fullest extent permitted by law, neither Mitsubishi Electric/BDT nor its third party service providers engaged for the purposes of this Competition, will be liable to any person for any liability, loss, expenses or damage howsoever arising whether in contract, tort, negligence or otherwise, in connection with the Competition and/or use or any use or non-use of the Prize, even if the party had advised of the possibility of such damages in advance, and all such liability is expressly excluded.
6. By entering this Competition, you agree to indemnify and hold harmless Mitsubishi Electric/BDT, Facebook, and their officers, agents, servants and employees from any and all claims, demands, actions, losses, liabilities and suits arising out of or attributable to your participation in the Competition, including (without limitation) any claim or allegation that your entry infringes a third party’s intellectual property rights or constitutes an unlawful disclosure or misuse or misappropriation of another party’s confidential information.
